HIERARCHY OF DOCUMENTS

GOVERNING DOCUMENTS OF CONDOMINIUM ASSOCIATIONS

The general hierarchy of authority for governing documents is important to know because each document addresses different issues involved in operating your association. The hierarchy also places greater legal weight in a court of law the higher you go, lower documents should not conflict with higher documents and if so, the higher documents will prevail. Sometimes there may be conflicting information, so it is important that the Board of Management know which documents would prevail. For example, your bylaws may state a board of three while your CC&R’s state a board of five – the CC&R’s would prevail.

For clarity as to what constitutes common areas, please refer to our CC&Rs paragraphs 9 and 10.

These paragraphs of the Palmotillo CC&Rs reads as such,

9. Each residential unit shall be a separately designated and legally described freehold estate consisting of a parcel and the improvements thereon, and an undivided interest in the common elements of the tract of which said parcel shall be a part.

10. The “Common Elements” shall be defined as including, but not limited to, land not otherwise specifically conveyed with individual units, community and commercial facilities, if any, swimming pools, pumps, trees, pavements, streets, pipes, wires, conduits, and other public utility lines. No building shall be constructed on any part of the common elements, except common laundry facilities, storage buildings, and covered carports.

We have 47 parcels in the Palmotillo COA. To find your parcel, log into the Maricopa County Assessors website. Parcel Viewer then click the acknowledgement box and select OK. You will then need to either just zoom in to Sun City or enter your Parcel Number. All parcel numbers in Palmotillo start with 230-07- and to that you will need to know your 3 digit number of 177 through 223. Example, 23007177 would be the lowest number we have in Palmotillo and the highest would be 23007223. You need not enter the “-” character, but you can if you want to. 230-07-177 or 230-07-223 or any of the other 45 numbers between.
